Please read these terms before using our services.
1. About These Terms
These terms govern the relationship between Forth Digital ("we", "us") and you ("the client") when you purchase any of our website services. By engaging our services, you agree to these terms.
2. Our Services
We design, build, and host websites for small businesses. Exactly what is included depends on the plan you choose — see our pricing page for a full breakdown. Services not listed in your plan (such as additional pages, major redesigns, or e-commerce features) are available at an additional cost, quoted in advance.
3. Payment
Fees are charged monthly in advance. We will notify you of the amount and payment method before your site goes live. If payment is not received, we reserve the right to suspend your website until the account is brought up to date. Continued non-payment may result in termination of your service.
4. Commitment and Cancellation
The Starter plan is month-to-month. You can cancel at any time with no penalty — your site will remain live until the end of the current billing period.
The Essential and Growth plans require a 12-month commitment. After your initial 12 months, the contract continues on a rolling monthly basis until either party gives 30 days' written notice to cancel.
Early termination of an Essential or Growth plan before the 12-month period is complete may result in the outstanding balance for the remaining months becoming due.
5. Your Responsibilities
You are responsible for providing accurate content (text, images, business information) for your website. You confirm that any content you provide does not infringe third-party intellectual property rights and is not unlawful. We are not responsible for errors or issues arising from content you have provided.
6. Domain Ownership
Your domain belongs to you at all times. We will never transfer your domain into our own accounts. If you leave our service, we will assist you in pointing your domain to a new provider at no additional charge.
7. Intellectual Property
Once your account is fully paid up, you own the content and design of your website. We retain the right to display your site in our portfolio unless you ask us not to. Any third-party tools or frameworks used in building your site remain subject to their own licences.
8. Security
We build all websites with security best practices in mind — static hosting, no database, no unnecessary plugins, and no third-party tracking scripts. However, we are not liable for any security breach, hacking incident, data theft, malicious attack, or unauthorised access affecting your website or its visitors. No hosting environment can be guaranteed completely secure. We recommend keeping any login credentials private and notifying us promptly if you suspect any issue.
9. Uptime and Availability
We host websites on Netlify, a reputable third-party hosting provider. While we aim for high availability, we cannot guarantee 100% uptime and are not liable for any downtime caused by Netlify or other third-party infrastructure providers. We will make reasonable efforts to resolve any outages promptly.
10. Third-Party Services
Your website may use third-party services such as Netlify (hosting), Cloudflare (analytics, DNS), and Google (Search Console, Business Profile). These are subject to their own terms and privacy policies. We are not responsible for changes, outages, or data practices of these providers.
11. Limitation of Liability
To the fullest extent permitted by law, Forth Digital's total liability to you for any claim arising from these terms or our services shall not exceed the total amount paid by you in the three months preceding the claim. We are not liable for any indirect, consequential, or loss-of-business damages.
12. Changes to These Terms
We may update these terms from time to time. We will notify you of any significant changes by email. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
13. Governing Law
These terms are governed by the laws of Scotland. Any disputes will be subject to the exclusive jurisdiction of the Scottish courts.
